These Terms of Use ("Terms") govern your access to and use of the website jamschildrensfoundation.org and any related services (together, the "Site") operated by JAMS Children's Foundation ("JAMS", "we", "us" or "our"), a non-governmental organisation registered in Uganda. By accessing or using the Site you agree to be bound by these Terms.
1. About JAMS Children's Foundation
JAMS Children's Foundation is a not-for-profit organisation duly registered under the laws of Uganda, including the Non-Governmental Organisations Act, 2016. All funds raised are applied exclusively to our charitable objects.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to make a donation, register as a volunteer, or otherwise transact with us through the Site.
3. Donations
- All donations are voluntary and, unless expressly stated otherwise, non-refundable once processed.
- Donations may be restricted to a specific campaign at your request. Where a campaign is over-subscribed, fully funded or cannot proceed for any reason, we may apply your donation to a closely related program with a similar purpose.
- Payments are processed through third-party providers regulated in Uganda. We do not store full card or mobile-money credentials.
- If you believe a donation was made in error, please contact us within seven (7) days and we will review the request in good faith.
4. Use of the Site
You agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose;
- Attempt to gain unauthorised access to the Site, its servers or related systems;
- Interfere with or disrupt the operation of the Site;
- Upload or transmit any material that is defamatory, obscene, or that infringes the rights of any person;
- Use the Site to impersonate JAMS or to raise funds in our name without written authorisation.
5. Intellectual property
All content on the Site, including text, graphics, logos, images, audio and video, is owned by or licensed to JAMS Children's Foundation and is protected under the Copyright and Neighbouring Rights Act, 2006 of Uganda and other applicable laws. You may view and share content for personal, non-commercial and educational purposes with appropriate attribution. Any other use requires our prior written consent.
6. User submissions
If you submit content to us (for example through a contact or volunteer form), you confirm that the content is yours to share and you grant JAMS a non-exclusive, royalty-free licence to use it for the purposes of responding to you and running our programs, subject to our Privacy Policy.
7. Third-party links and services
The Site may link to third-party websites or services (for example, payment gateways and social media). We are not responsible for the content, policies or practices of any third party, and you access them at your own risk.
8. Disclaimers
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by Ugandan law, JAMS makes no warranties, express or implied, regarding the operation of the Site, the accuracy of information on it, or its fitness for a particular purpose.
9. Limitation of liability
To the extent permitted by law, JAMS, its trustees, staff and volunteers shall not be liable for any indirect, incidental or consequential loss arising from your use of the Site, save for liability that cannot be excluded under Ugandan law (including for fraud or gross negligence).
10. Safeguarding and complaints
JAMS operates a zero-tolerance policy toward child abuse, exploitation and any breach of our safeguarding standards. If you have a safeguarding concern, please contact us immediately at info@jamschildrensfoundation.org.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Uganda. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Uganda.
12. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
